It's nothing you have to worry about, as your employer, or, better, their lawyers, will get you the visa. What you need to do is apply for jobs you are qualified for, and make sure that your employer is willing to sponsor you for an H1-B.



Those visa petitions are only submitted in the first week of April, a few months later you would have your interview at the US consulate in your country of residency, and if approved, you can start working on October 1st the same year. The H1-B is valid for 3 years and can be extended for another 3 years after that.



In order to be hired, you need to have a degree in one of the hard sciences, technology, engineering, or mathematics. A lot of H1-B visa holders are computer scientists. Ideally you should have a Master's degree and several years of experience in your field of expertise.

The H1 visa gives you the legal right to work and live in the US under the condition you stay employed in the field you apply for. Getting this visa depends on finding an employer who is willing to hire you so if you're career is not in high demand, you probably won't be able to get a work visa. A doctor for instance usually has no trouble finding work here, a nurse however is rarely given a work visa because there are so many young American boys and girls training for those types of jobs.



Basically there has to be a shortage of workers in the field you're applying for. If there is, you'll have no trouble getting a work visa, if there isn't you will.

You cannot apply for the H1B its the person or company who wants to employ you who files you cannot just apply for a Work Permit yourself. And unless the Job has a shortage of US workers you will get a visa denial from USCIS. And the US has no Holiday visa program so you cannot move there for a year to work as any employer will not even waste their time sponsoring you as it costs too much for such a short period they can hire a US Citizen and have no costs.

Yes its possible for you to get the visa. Your employer should apply for it.

There are basically NINE ways that you can get a visa to live and work in the US:



(1) Marriage (or engagement in anticipation of marriage) to a US citizen.



(2) You have skills that are in short supply in the US e.g. scientific or medical training. A degree is normally a must. Or you have superior specialist skills with at least 12 years experience. (H visas)applications next received on 1st April 2014



(3) You have an Employer who is willing to transfer you - but even the employer has to make a good case for you - so you have to be a manager unless you fall under category (2) above.(L visas)



(4) You may get a Green card in the diversity lottery (UK citizens, except N.Ireland, are not generally eligible unless you, your spouse or parents were born abroad or held a different citizenship.



(5)You own or buy business (does not get you permanent resident status i.e. no green card)You must be a national of a qualifying Treaty countries. The business must have a minimum value of around $150k (more the better) bearing in mind you will need somewhere to live and with any startup business you will need at least 2 years living money as back up. So a figure of $350k would be a nearer minimum (E-2 visas)



(6)You are an "investor" i.e. you have at least US $1m in assets to bring with you. half of that in a few areas. And your background will be investigated to the hilt. (EB-5 visas)



(7)You have a close relative (mother, father, brother, sister and no further) who is an US citizen who would sponsor you, approx time this take 2-12 years?



(8.The R1 visa is available to foreign members of religious denominations, having bona fide non-profit religious organizations in the U.S., for entering the U.S. to carry on the activities of a minister or religious worker as a profession, occupation or vocation



(9)THE UNUSUAL You are in a position to claim refugee status/political asylum. or You get a member of Congress to sponsor a private bill with legislation that applies just to you.

Recruitment agent will not take you seriously if you are not already in the US. Writing for jobs is really a waste of time; likewise US employers have no idea what foreign qualification are or mean (except Degrees) it may pay you to get your qualification translated into a US equivalent, there are Companies that do this (www.wes.org) ..

But if you are getting a visa under (2) above then you need a job offer before you can get the visa. Your Employer will be your sponsor this will cost them upward of $5k. So you can see you have to be offering something really special to get considered They may also have to prove to the Dept of labor that tere is no American who can do the job if the position is to be permanent ©

Apply a job through online now in the US company. If you are selected, they will send an offer letter.

If you are highly skilled in STEM (Science, technology, engineering, mathematics), health, legal,.... You are eligible. Go to the US consulate and apply H-1B visa.



Most of the high skilled professionals are seeking for a job in the USA so the computation also increasing gradually. Every year USCIS granted 65,000 H-1B visas (limited), but this year USCIS gets almost double (124,000 ) amount of petitions.



If more applications came to the USCIS, elect the candidate by using a lottery system (Recent green cards also done under lottery system). If you are entity is elected, you join in the U.S. Company. It's the process. So two steps to get an H1b, such is get a job in US company (they will sponsor you) and elected by the USCIS. So If you have a minimum bachelor of degree with high skills or 12 years experience in the above fields, apply now.

the H1b would allow you to do that, however they're limited in number. at the moment, none are available and you'd have to wait until next April to even have a chance to get one. since the economy has improved a bit, the numbers of people applying for this visa have gone way up. in reality, its not a visa you can apply for on your own. you need an employer not only willing to hire you, but willing to spend the time and money it would take for the paperwork. If you did find one before April, you wouldn't be eligible to work on that visa until October 2014. So, at the moment, its more than merely hard to get, Im afraid.
