conditional green card problem!!! HELP!!!?

i only have a conditional green card which will last for 2 years.

my mom has a conditional green card too because she married my step father who is an American Cit.

the only problem is my mom filed the removal of her conditional green card LATE!!! and since it was late she the application was sent back to her and now she has to apply to re-open or whatever you call it.. to have her 10 yr. green card.

I, on the other hand got a year extension to my green card and my mom and I got our fingerprints taken.

I have dreams of becoming a US Cit. and I want to have that 10 yr. green card as well. (just for assurance)

since i still have my conditional green card, when do you think is the best time for me to file a petition for the conditional removal??

should i file it by myself? or is my green card linked to my mom??

The very best time for you to file to remove the conditional status of your card is approximately 90 days before the second anniversary of the date on which you obtained conditional permanent residence. In other words, 90 days before your card expires.



If a petition to remove the conditional basis of your status is not filed within this period, your conditional permanent status will be terminated automatically and you will be subject to deportation from the United States.



Children who cannot be included in a joint petition filed by the parent and parent's petitioning spouse due to the child's not having acquired conditional resident status concurrently with the parent, the death of the parent, or other reasons may file a separate Petition to Remove the Conditions on Residence (Form I-751).

You can apply up to 3 monts before your card runs out, i would do it as soon as you can, its expensive around 600 dollars, if your step father petitioned for you then your card is not linked to your mom, if your mom petitioned for you then you are linked to her. If you have questions go to the INS office, do not call the 1800 number you will get through to someone who doesnt know what they are talking about. This happened to me at least 5 times and i got wrong info that cost me money. go down and ask questions and dont leave untill you have all the info, be persistent cos they will try to rush you through. I got my greem card four years ago and applies to have conditions removed june 07 and i am still waiting for a response, a had my fingerprins done and am still waiting, so do it asap. Hope this helps.

the same thing happened to my wife. if i were you, i would file the I-751 (remove conditions form) 3 - 6 months before your card expires. my wife is still waiting for her new card, it has been 6 months already
